Justices Won’t Revive Banana-Taped-To-Wall Art Copyright Case

The US Supreme Court declined to revive allegations that an Italian artist’s $6 million idea of taping a banana to a wall copied from another’s work.

Joe Morford failed to convince the justices to examine a finding that Maurizio Cattelan didn’t have a reasonable opportunity to access his work as they denied his petition Monday. Cattelan’s “Comedian” became a sensation at the Art Basel fair in Miami in 2019.

Morford argued “Comedian” was strikingly similar enough to the banana half of his “Banana and Orange” work—with each fruit also being duct-taped to a wall—that he didn’t need to establish access. …
