The social network X, formerly Twitter, is once again under judicial investigation in France. Following a report by MP Eric Bothorel on January 12, the Paris public prosecutor’s office is examining the functioning of the algorithms of Elon Musk’s platform, suspected of manipulation.

The Paris public prosecutor’s office opens an investigation into X of Elon Musk

The Paris public prosecutor’s office launched an investigation on Friday, February 7, into the social network X following the report by MP Eric Bothorel. This investigation, which follows a seizure on January 12, concerns suspicions of manipulation of the automated data processing system (STAD) of the platform.

The case is part of a broader context of monitoring the social network. At the end of January, the Arcom (French digital regulator) alerted the European Commission following complaints from MEP Aurore Lalucq and Senator Marie-Claire Carrère-Gée, who denounce excessive visibility of Elon Musk’s content on the platform.

The problems of X in France do not stop there. Since its acquisition by Musk, the platform has faced numerous criticisms. Another investigation is underway for complicity in aggravated moral harassment, following a complaint in April 2023 from Magali Berdah, who accuses X of having ignored her reports of cyberharassment.

Issues that transcend French borders

The French investigation adds to legal actions already taken at the European level. In December 2023, the European Commission launched its own investigation into X regarding possible manipulation of the algorithms favoring Elon Musk. Brussels is also demanding that the platform provides complete documentation on its recommendation systems before February 15.

These multiple proceedings occur in a particular context: the application of the DSA (Digital Services Act), which requires more transparency from digital platforms, but also in a climate of growing trade tensions. Indeed, Washington recently announced increased tariffs targeting Canada, Mexico, and China, with a risk of extension to Europe.

This situation echoes the recent statements of Donald Trump at Davos, where he accused the European Union of treating American companies very, very unfairly. The investigation into X, whose owner Elon Musk is influential and close to Trump, could thus add to the friction points between Europe and the United States.
